The endorsement of military courts by the supreme court of Pakistan is akin to giving a new life to the doctrine of necessity that haunted the democratic growth and evolution of institutions in the country. It is a paradox that the institution responsible for upholding the constitution and guarding the rights of the people of Pakistan, has given a verdict that undermines its very own sanctity. The decision is rightly criticized by the international court of justice; it is synonymous to accepting that justice cannot be delivered to the people, rather, it needs to be imposed upon the people by military courts. Pakistan’s fight against terrorism is going to suffer irreparable damage as a consequence of this decision. However, the dissenting note by the chief justice is a flicker of light in darkness. Ironically, even justice needs justice in the land of pure today.
