Yemen is facing an international conflict between two powers. The Houthis are allegedly backed by Iran while Hadi is arm child of Saudia. Couple of weeks ago, Saudi Arabia launched a military intervention in Yemen to stop Houthi advances through the country. Calling it “Operation Decisive Storm,” Saudi Arabia acted in coordination with a coalition including the United Arab Emirates, Qatar, Kuwait, Bahrain, Jordan, Morocco, Sudan, Pakistan and Egypt. Gulf Cooperation Council (GCC) members announced that the military action was taken in response to Yemeni President Hadi’s request to the leaders of Saudi Arabia but the question is , Does the coalition’s military intervention constitute a lawful use of force?
Yemen is a nation in the throes of civil war and perhaps in the process of regime change. But Yemen as a state fully enjoys the protections of Article 2(4) of the United Nations Charter, under which “all members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state. The second aspect of this issue is Saudi Arabia’s framing the increasing influence of the Houthis as a threat to its and the region’s security. Article 51 of the UN Charter allows states to act in self-defence only when they have been attacked. It is not entirely clear whether the news of some attacks on Saudi Arabia’s border posts is well founded, whether the Houthis from Yemen are responsible for such attacks and if such attacks pose any real threat to Saudi Arabia’s territorial security. Accordingly, it is not clear whether reliance on the principle of anticipatory self-defence will hold ground in the present circumstances.
Thus if someone comes to UN charter, it is violation of charter and most hilarious thing is that the father of UN, that is rightly the USA is supporting Saudi attacks, which shows its double standards.
